CHECK & GO AUTO INSPECTION

TERMS AND CONDITIONS OF SERVICE AGREEMENT

Effective Date: February 2026

Governing Law: Province of Ontario and/or Province of Quebec, Canada

  1. LEGAL ACCEPTANCE

By booking, scheduling, paying for, or receiving any service from Check & Go Auto Inspection (“Company”, “We”, “Us”), the Client (“You”, “Buyer”) agrees to be legally bound by this Agreement.

If you do not agree to these Terms, you must not use our services.

  1. NATURE AND LIMITATION OF SERVICE

Check & Go Auto Inspection provides a limited, mobile, non-invasive pre-purchase vehicle inspection.

The Service:

  • Is visual and observational in nature
  • Is performed at the seller’s location
  • Reflects the vehicle’s condition only at the time of inspection
  • Does not involve dismantling mechanical systems
  • Is not a provincial safety certificate
  • Is not a mechanical warranty

We do not open engines, transmissions, sealed systems, or perform destructive testing.3. NO WARRANTY – EXPRESS DISCLAIMER

THE COMPANY PROVIDES NO WARRANTY OF ANY KIND.

We expressly disclaim:

  • Any express or implied warranty
  • Any warranty of merchantability
  • Any warranty of fitness for a particular purpose
  • Any guarantee of future reliability
  • Any guarantee that the vehicle will pass safety inspection

Used vehicles are inherently unpredictable and may fail at any time after purchase.

The Client acknowledges that the inspection reduces risk but does not eliminate it.

4. HIDDEN OR FUTURE DEFECTS

The Company shall not be liable for:

  • Latent or hidden defects
  • Internal engine or transmission damage
  • Electrical module failures
  • Odometer manipulation not detectable at time of inspection
  • Seller misrepresentation
  • Issues arising after the inspection date
  • Normal wear and tear

The purchase decision remains solely the Client’s responsibility.

5. OBD2 & DIAGNOSTIC LIMITATIONS

Diagnostic scans:

  • Detect stored and active fault codes
  • May not detect intermittent faults
  • Cannot predict future failures
  • May not reveal recently cleared codes

Absence of codes does not guarantee absence of mechanical issues.

6. ROAD TEST CONDITIONS

Road testing is performed only if:

  • The vehicle is legally registered
  • The vehicle is insured
  • Weather and road conditions are safe

The Company is not responsible for:

  • Traffic violations
  • Insurance matters
  • Pre-existing unsafe vehicle conditions
  1. PAYMENT POLICY
  • Full payment is required prior to or at the time of inspection
  • Inspection fees are non-refundable once the inspection has been completed
  • Travel fees (if applicable) are non-refundable once the inspector has been dispatched
  1. COMPANY PERFORMANCE & REFUND POLICY

If the Company fails to perform the scheduled inspection due to its own fault, including but not limited to:

  • Failure to attend the confirmed appointment
  • Cancellation initiated by the Company without rescheduling
  • Inspector unavailability without mutual agreement

The Client shall be entitled to a full refund of the inspection fee paid.

Refund conditions:

  • Refund shall be issued to the original payment method
  • Refund shall be processed within a reasonable timeframe
  • Payment processor delays are outside Company control

No refund shall be owed if the inspection cannot proceed due to:

  • Seller cancellation or refusal
  • Vehicle unavailability
  • Client cancellation
  • Incorrect address provided
  • Unsafe environment
  • Vehicle mechanical breakdown prior to inspection
  • Severe weather or events beyond reasonable control
  1. FORCE MAJEURE

The Company shall not be liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to:

  • Severe weather conditions
  • Natural disasters
  • Road closures
  • Government restrictions
  • Mechanical breakdown of service vehicle
  • Emergency situations

In such cases, the appointment may be rescheduled or refunded at the Company’s discretion.10. LIMITATION OF LIABILITY

To the maximum extent permitted by Canadian law:

THE COMPANY’S TOTAL LIABILITY IS STRICTLY LIMITED TO THE AMOUNT PAID FOR THE INSPECTION SERVICE.

Under no circumstances shall the Company be liable for:

  • Repair costs
  • Towing costs
  • Loss of use
  • Loss of income
  • Emotional distress
  • Indirect, incidental, consequential, or punitive damages

This limitation applies regardless of legal theory.11. INDEMNIFICATION

The Client agrees to indemnify and hold harmless Check & Go Auto Inspection from any claims, disputes, or legal actions arising from:

  • The purchase of the inspected vehicle
  • Disputes with the seller
  • Mechanical failure after inspection
  1. INDEPENDENT STATUS

The Company is an independent third party and is not affiliated with:

  • The seller
  • The dealership
  • Any repair facility
  • Any financial institution
  1. REPORT OWNERSHIP

The inspection report:

  • Is for the Client’s use only
  • Is informational in nature
  • May not be modified or redistributed without written consent
  1. GOVERNING LAW

This Agreement shall be governed by the laws of the Province of Ontario and/or Province of Quebec, Canada.

Disputes shall be resolved in the courts of the applicable province.
